User agreement
1. GENERAL TERMS
1.1. The owner of an online learning platform is the Foundation of Nursultan Nazarbayev (“the Foundation”).
1.2. The user of an online learning platform (“Portal”) is any person granted access to the Portal (“User”).
1.3. By using the Portal, the User agrees to a legally binding agreement, effective immediately upon the first visit of the Portal.
1.4. This User Agreement (“Agreement”) is a public offer. By accessing the materials and Services of the Portal, the User is deemed to have entered into this agreement.
1.5. This Agreement, in whole or in part, may be modified by the Portal Administration at any time and without notice. Any changes will be effective immediately upon posting of the amended agreement on the Portal.
2. TERMS OF USE OF MATERIALS POSTED ON THE PORTAL
2.1. Materials of the Portal can be copied, reprinted, and redistributed only with prior written permission from the Foundation and mandatory reference to the source.
2.2. The use of photos and videos of the Portal, including copying, distribution, and publication, must include the logo of the Foundation and reference to the Portal as a primary source of information (it is prohibited to crop and erase the logo on the photo and video materials of the Portal).
2.3. The news material and information posted on the Portal can be redistributed only after the original text is rewritten. When redistributing the material, a direct link to the original material and the reference to the Foundation (the Foundation of Nursultan Nazarbayev reported) in the first paragraph are mandatory.
2.4. Upon receipt of the written consent from the Foundation to use infographics, photo, video, and audio materials, any edit of these materials is prohibited. Should you have any complaints please contact the administrators or moderators of the Portal.
3. COLLECTION AND PROCESSING OF PERSONAL DATA
3.1. The Foundation and its Partners gather and process Personal Data of Users. Collection and processing of personal information of Users are conducted for the purposes of the User agreement, provision of Services to User, including sending notifications, information regarding the use of Services and processing of requests from User, notifying User about changes or modifications to the User agreement, improving the quality of Services, developing and suggesting new Services, including offering personalized services to User, participation of Users in projects and competitions as well as the fulfilment of the rights and obligations by the Foundation in accordance with applicable law. Additional purposes for the collection and processing of Personal Data may be stated as part of the use of certain Services.
3.2. The Foundation or Partner may collect and process data provided by User when using the Services of the Portal, including but not limited to a mobile phone number, e-mail address, IP address, geolocation, search history, date and time of visits, as well as available “cookies”, information about the browser and operating system, data provided by the user, such as profile image (image posted by the User), username, gender, date of birth, consent and confirmation of the User's rights, and other data necessary to achieve the purposes for collection and processing specified in clause 2.1 above.
3.3. Personal data can be added by User. In addition, the Foundation may supplement or clarify Personal Data of User through open sources or from third parties on the basis of contractual relations with the Foundation.
3.4. The Foundation keeps Personal Data on the territory of the Republic of Kazakhstan for as long as necessary to achieve the purpose of their collection and processing under the User Agreement and for three years after the termination of this User Agreement, unless a shorter period is established by any applicable law.
3.6. The User may withdraw his or her consent for the collection and processing of Personal Data. The withdrawal of consent may result in the suspension or termination of the User Agreement. To withdraw consent, the User must submit a written statement to the address of the Foundation specified in the User Agreement.
4. SAFETY MEASURES USED TO PRESERVE CONFIDENTIALITY
4.1. Personal Data of Users is confidential information and is protected by the law of the Republic of Kazakhstan.
4.2. The Foundation and its Partners have advanced technologies and internal procedures and maintain all security procedures to protect Personal Data from outside interference, unauthorized access, alteration, disclosure and destruction. The Foundation ensures the existence of an agreement with each of its Partners in the form stipulated by the legislation of the Republic of Kazakhstan, providing for the confidentiality of information, including personal data of Users.
4.3. Services ensure the protection of the transmitted data between the User and the Services on the internet via a secure HTTPS protocol using TLS v1.2 cryptographic protocol.
4.4. Access to Personal Data of Users is strictly limited to the Administration of the Portal for business purposes.
4.5. All employees of the Foundation and Partners and other persons involved in the work with Personal Data sign an obligation not to disclose confidential information, and are also warned of possible disciplinary, administrative, civil and criminal liability in case of violation of the norms and requirements of the current legislation of the Republic of Kazakhstan in processing Personal Data.
5. SHARING PERSONAL DATA WITH THIRD PARTIES
5.1. Sharing Personal Data with third parties is carried out in cases provided for by the legislation of the Republic of Kazakhstan;
5.2. To fulfil the User agreement and improve user experience in using the Services of the Portal, the Foundation develops, enhances, optimizes and incorporates new features of the Services (including information, education, entertainment and other services and products), along with the involvement of affiliated parties and Partners. To ensure the fulfilment of these objectives, the User agrees and authorizes the Foundation, in compliance with applicable law, to process the Personal Data of the User, including the results of processing of such data by automated means as well as in the form of an integer and/or text and identifiers, their transfer to affiliated persons and/or Partners, as part of exercising such consent to the processing, including cross-border transfer.
5.3. When sharing Personal Data with third parties, the Foundation undertakes all possible measures to protect it from unauthorized access and obliges to use it in accordance with the terms of this Agreement and the legislation of the Republic of Kazakhstan. The Foundation ensures the right of Users to privacy and therefore, no third party, including Partners, has access to the correspondence of Users.
5.4. Notwithstanding the provisions of clauses 4.1 - 4.3 above, the User acknowledges the transmission of his or her data via the internet, and the Foundation does not guarantee the security of the transmitted data by Users, to which third parties may get unauthorized access as a result of any illegal actions. In this regard, any transmission of data is done at own risk of the User and the Foundation is not liable for leakage of data or part of it and causing damage to the User.
